marlenecoudeville.fr is an online shop. The products that are sold are exclusively created by Marlène Coudeville and will not be sold out of the online shop marlenecoudeville.fr except specific agreement.
Marlène Coudeville keeps her right to adapt or change these conditions at any time, nevertheless the general terms that will be implemented are the ones that are online at the time of the order.
1- General terms approval
The current general terms rule the contractual relationships between Marlène Coudeville and her customer, the two parts accepting them entirely. The general terms namely specify the conditions of order, payment, delivery and would be returns of items previously ordered.
The customer can freely and simply consult the general terms at any time by clicking on the link “General terms”. Therefore any order placed by a customer will induce his definite and irrevocable agreement on these general terms.
All the products on the website can be purchased until they are visible on the site, within the limits of available stocks. However if a product is unavailable,the customer will be notified by email as soon as possible, and offered to order another article featured on the website for replacing it, or to cancel his order. If the order is to be cancelled, the customer will be reimbursed in case his account was already debited.
Prices quoted are accurate at the time of posting the product on the website and all products are fairly described. However, an order may not be accepted if there are material errors in the description of the goods that have been ordered or in their prices. All prices and offers are subject to change.
Colors of the products appearing on the website are as near as possible to the color of the product. However, the actual color seen on computer depends on the computer equipment, and accordingly, the exact color of the product can’t be guaranted on delivery.
To complete his order, the customer has to click on “Place order”. According to the 2000, March 13th law on electronic signature, each order form that is signed by this click is considered as an irrevocable engagement of the customer and cannot be questioned afterwards except in the cases that are forecasted and explained in the item “”Return and replacement policy”. The automatic registration systems are considered as a proof of the nature, content and date of order.
Any internet order requires that the customer provides accurate and complete information about himself: title, name, phone, email address, billing address and delivery. In case of mistake in the shipment address, Marlène Coudeville will not be responsible of not being able to deliver the product.
3- Order confirmation
As settlement of the contract, the order will be accepted by way of a confirmatory e-mail (‘Confirmation of Order’) which will confirm that it is possible to send the ordered goods, their price, to the delivery address.
Marlène Coudeville has the right not to confirm an order for any reason, namely in case of a supply problem or in case of a previous litigation with the customer. The customer will be informed in any way.
Prices are labeled in euros. Marlène Coudeville keeps her right to modify at any time and without notice the prices of products offered on the site, nevertheless products are invoiced on the basis of the rates posted on the site at the time of placing the order. It does not include the delivery fees that will be mentioned before the order confirmation.
Duties and taxes
Delivery in France and countries belonging to the European Union (EU)
The order will be established TTC. The prices include the VAT applicable on the day of the order. Any rate change will be reflected on the price of products.
Delivery in French overseas departments and territories
The prices will be established without VAT. At the delivery the customer will have to pay the customs duties that are due to import goods.
Delivery in other countries
The prices will be established without VAT. At the delivery the customer will have to pay the customs duties that are due to import goods. The customer is entirely responsible to check the possibility of importing before placing his order.
Products remain Marlene Coudeville’s property until their complete payment.
The payment is entirely due at the order and will be achieved by credit card through Paypal a leading and secure service provider for the processing of online payments. Paypal uses the SSL (secure Socket Layer) protocol that ensures that all the information gathered can’t be read by anyone during the transaction.Having a Paypal account is not compulsory.
The order sent by a customer will be considered as on order once the bank centers that are concerned give their agreement.In case the bank centers don’t give their agreement, the order will automatically be cancelled and the customer will be informed by email.
On request, an invoice will be sent to the customer.
6- Order processing
The order will be executed within around 7 days after Marlène Coudeville has sent the order confirmation unless the product is not immediately available or unless specific agreement of the two parts.
These times are indicative and can’t be guaranteed. Longer delivery delays will not lead to any damages or product refusal at the delivery or order cancelling.
If a product is running out of stock, Marlene Coudeville will inform the customer as soon as possible and let him know about the forecasted product availability. The customer will confirm by email if he chooses to wait until the product is available or if he chooses to get a refund.
The products will be delivered at the delivery address fulfilled byt the customer on the order form and according to the following areas :
– European countries and French overseas departments and territories
– the rest of the world
Please note that any order sent to a PO Box will not be accepted.
The delivery fees are paid by the customer as mentioned on his invoice. The parcels in France and French overseas departments and territories are delivered by “Colissimo France” and “Colissimo Outremer”., the other ones are delivered by “Post Export Marchandise”. A tracking number and the delivery date for your order will be sent to the customer who will be able to follow his delivery at any time.
Marlène Coudeville can’t be held responsible for any direct or indirect consequences of an order cancellation or delay in delivery for any reason whatsoever and in particular in case of disruption or postal strike or transport and in general, in case of events beyond our control.
At the delivery the customer will have to check the parcel : content, conformity and state of the product. In case of loss or default, the customer will have to report it within 3 days at the email address : email@example.com
8- Return and replacement policy
According to the L 121-16 law of the Consumption Code, the customer has a 7 days delay after the delivery to send the product back and exchange it or get a refund.
Before returning any product the customer must obtain a return merchandise authorization obtained by emailing your request firstname.lastname@example.org. The email should specify the reason why the goods are being returned.
All returns goods should be in perfect conditions in their original packaging. In case the return parcel get lost, there will be no refund ;all goods shall remain the responsibility of the customer until they are duly received.
Return freight charges must be covered by the customer. Initial shipment cost will not be refunded.
No carriage forward parcels will be accepted, these will be sent back to the sender.
Exchanges are subject to product availability. Exchanged items can only be dispatched after the returned goods have been received and undergone a quality control check. Return shipping charges must be covered by the customer. Iinternational customs duties and sales taxes are not refunded for shipments outside the European Union (EU).
Only items properly returned under this policy are eligible for a refund.
If the customer chooses a refund, the full purchase price (shipping, taxes and customs duties excluded) will be credited to your credit card, within 30 days after receiving the return.
If the customer receives a defective item, or damaged during shipping, he has to inform Marlène Coudeville at the email address :email@example.com within 2 days after delivery. The product will be replaced according to product availability.
If there is extensive damage to the carton, the customer has to refuse the parcel and inform Marlène Coudeville of it by email at the following address : firstname.lastname@example.org
In this specific case, no shipping costs will be charged on the customer. All refunds will be made within 30 days after the return of the parcel. To request a refund, the customer will have to communicate his bank datas. For countries outside the European Union, the customer will have to specify to customs that it is a “return for non-compliance”.
This contract and general terms are subjected to the French law. In the event of complaint, only the French courts will be qualified.
10- Private policy
All personal information the customer supplies will be treated in accordance with French Data Protection Act dated January 6th 1978, the customer has a right of access, of correction and opposition to the personnel data concerning himself .
Marlène Coudeville commits herself not to disclose the customer’s personal datas. These will be used only for orders treatments and for a personalized communication such as e-mails.
The encryption technology used by the Paypal secured payment service offers much security to the datas. Inherent security implications of being and transacting online over the Internet still exist and Marlène Coudeville will not be hold responsible for any breach of security.
